South Africa Releases Draft Regulations for Cross-Border Crypto Asset Transfers, Clarifying Reporting Obligations

The South African Treasury and the South African Reserve Bank have jointly released a draft of the "Crypto Asset Handbook," which clearly outlines the regulatory and reporting obligations for cross-border transfers of crypto assets for the first time. The draft requires individuals to conduct cross-border transfers of crypto assets through licensed service providers and report them to the Financial Surveillance Department (FinSurv) of the South African Reserve Bank. This move aims to prevent crypto assets from being used to evade foreign exchange controls and to assist authorities in detecting and blocking illegal capital flows. The draft specifies that a cross-border transaction occurs only when assets are transferred from a local licensed crypto asset service provider to an overseas service provider or transferred into a private non-custodial wallet. Buying and selling crypto assets in rand through local service providers does not trigger reporting obligations. Currently, individuals are only allowed to transfer crypto assets abroad within their existing foreign exchange limits. The South African Reserve Bank has stated that this framework does not grant crypto assets legal tender status and has not yet differentiated between different types of crypto assets, with related research still ongoing. The deadline for public comments on the draft is September 30.
