SBF petitions Supreme Court to void 11 billion forfeiture order
Jeffrey Fisher, counsel for former FTX CEO Sam Bankman-Fried, filed a petition with the U.S. Supreme Court on Sept. 10, arguing that an 11 billion forfeiture order violates the Eighth Amendment’s ban on excessive fines. Fisher contended that the ruling is a monetary judgment rather than a recovery of actual assets, which would block Bankman-Fried’s future income even after release, resulting in lifelong poverty. He also noted that jurors were only shown customer loss figures during the trial, while details about the bankruptcy estate’s repayment plan, which repaid 105% of customer claims due to a successful investment in Anthropic, were withheld from the jury.
